JUDGE CAMACHO SAYS AFFIRMATIVE DEFENSE ARGUMENT DOESN'T STAND AT PRELIMINARY HEARING FOR FORMER DPS COMMISSIONER

The Judge says, in the 11 page order, the affirmative defense has to be proven through preponderance of the evidence, a higher burden of proof than probable cause.  The Judge concludes affirmative defense must be determined by the ultimate trier of fact, the jury, in a trial.
